An employee engaging in hard drugs? Then as a business owner you need to be clear. This case shows that taking action pays off and that the courts support you in this.
Instant dismissal after multiple warnings
An employee of a floriculture company was warned earlier because of undesirable behavior. When it later became clear that he was involved in trafficking hard drugs, the company had no choice but to intervene. The employee was not honest about his involvement and came up with all sorts of lies, but the evidence was clear. Instant dismissal followed. The employee took the matter to court, but received nothing: the dismissal was justified. The conduct was serious and the trust irreparably damaged.
No gray area
This case highlights the importance of a clear personnel policy as well as active enforcement. Maintaining a zero tolerance policy and actively drawing attention to the code of conduct ensures clarity. As an entrepreneur, this sends a powerful message: there is no room for criminal interference within this company. You not only protect your own company, but also contribute to a safe sector.
Reporting is important
Criminals abuse vulnerabilities. That can happen to anyone, but you are stronger if there is an internal culture in which reporting is normal. A clear reporting route helps. Colleagues who spot something suspicious need to know that their report will be taken seriously and that they will be supported.
Tip
Establish a code of conduct in your company and include clear rules around drug use, smuggling and other possible criminal activities (will not be tolerated).
Make sure rules and consequences of breaking them are clear. Address employees on this and intervene when things go wrong. Do you see or hear anything suspicious? Report this internally to the management or a confidential advisor. You can also call the district police at the floriculture site. In this way you can prevent bigger problems and work together on safety.
